Does, or should, social uprising lead to new legal form? Ukraine’s current situation following the Revolution of Dignity in 2013–2014, with continuing violent conflict in Donbas and Crimea, suggests that not only is it unclear how a ‘new’ form is assessed, but existing transitional policies and frameworks are unlikely to be clearly implemented and enforced. An alternative analysis of transformation is necessary to address the conflicting aftermath of uprising within a particular historical and cultural context. The transformation that is happening (...) in Ukraine is a continuum that is intellectual and psychological as much as reforming judicial systems and governance. Thinking transformation differently opens onto narratives, complexity of causes and a plurality of ideas of future, resolutions and justice. Such a shift in thought and analysis, informed by narratives and grounded research, is necessary in order to try to understand the current pursuit of justice in Ukraine. (shrink)

William Faulkner’s The Sound and the Fury has become a classic in literary history. Since its publication in 1929, it has sustained critical interest worldwide. Over time, analyses of this work have reflected shifting cultural perspectives of the inscribed human dynamics such as gender, race and sexuality. This paper contends that a similar critical development cannot be detected around the reception of the character of the “idiot,” Benjy. Faulknerian scholarship, regardless of its place in time or trend, persists in conflating (...) the dehumanized images of Benjy with the lived experience of disability, thus perpetuating oppressive disability prejudice and limiting the richness of the character’s metaphoric potential. Acknowledging this critical lacuna, historicizing and theorizing Benjy’s character from a disability perspective could lead to a deeper understanding of human experience. (shrink)

Fitzpatrick’s writing on international law did not constitute the main focus of his oeuvre. However, the determinate-responsive nature of law that characterised so much of his work did extend to an analysis of the generative force of international law. This article picks up on commentary from Modernism and the Grounds of Law (2001) and ‘Latin Roots’ (2010), among other contributions, to test this generative force of international law, which Fitzpatrick identifies as a necessary affirmation of the movement between the ‘determinate (...) but not ultimately determinate’ sovereignty of a singular nation state and the ‘illimitably responsive but not ultimately responsive’ force of the community (Fitzpatrick 2010, p. 46). We test Fitzpatrick’s view of international law through two examples of un-recognised states and the mechanism of non/recognition utilised by the international legal community to determine what constitutes a singular nation-state for participation in the community of international law. Our two case studies, North Cyprus and Crimea, illuminate the continuing relevance of Fitzpatrick’s schema. Through non/recognition, ‘states’ that are included-as-excluded participate in the ongoing affirmation of an international legal ‘community’, a community that continues to be constituted through the affirmation of imperial power. D'una banda, s'analitza la concepció del significat de les paraules quePlató sembla defensar en aquest diàleg; de l'altra, s'ocupa del problema dels orígens delllenguatge. Aquestes qüestions s'estudien en relació amb la perspectiva ontològica i epistemològicade Plató: essencialisme, teoria de la reminiscència i les tesis dels sofistes sobre laimpossibilitat de parlar amb falsedat. La conclusió és que en el Cràtil podem (...) trobar ja la preparació de la teoria del llenguatge que Plató necessitarà per a la seva ulterior teoria de les idees. (shrink)

Introduction to Sexology [Vvedenie v seksologiiu] by I. S. Kon has finally been published after having made the rounds of publishing houses for many years. This is the first Soviet publication devoted to a description and an analysis of the genesis, development, and state of a new branch of scientific knowledge about man-sexology-which affects every one of us. To be sure, General Sexual Pathology [Obshchaia seksopatologiia], a textbook for physicians edited by G. S. Vasil'chenko, which came out in 1977, has (...) an extensive introductory chapter on sexology, but it is limited to medical problems. Kon's book is an example of an interdisciplinary approach that provides an idea of the most essential components of sexology; it is thus addressed not only to the medical profession, but also to sociologists, philosophers of culture, psychologists, pedagogues, etc. The book takes into account the latest publications in this area of science.
